1.2 ALICI BİLGİLERİ

Sipariş formunda ve fatura bilgilerinde yer alan, e-ticaret sitesi üzerinden alışveriş yapan gerçek veya tüzel kişidir.

MADDE 2 - KONU

İşbu Sözleşme'nin konusu, ALICI'nın SATICI'ya ait internet sitesi üzerinden elektronik ortamda siparişini yaptığı ürünün satışı ve teslimi ile ilgili olarak 6502 sayılı Tüketicinin Korunması Hakkında Kanun ve Mesafeli Sözleşmeler Yönetmeliği hükümleri gereğince tarafların hak ve yükümlülüklerinin saptanmasıdır.

MADDE 3 - SÖZLEŞME KONUSU ÜRÜN VE ÖDEME

Ürünlerin cinsi, türü, miktarı, marka/modeli, satış bedeli ve ödeme şekli (Kredi Kartı / PayTR Güvenli Ödeme Altyapısı) siparişin sonlandığı andaki bilgilerden oluşmaktadır. ALICI, PayTR sanal POS altyapısı üzerinden yaptığı kredi kartı ödemelerinde tüm bankacılık kurallarına uymayı kabul eder.

MADDE 4 - GENEL HÜKÜMLER

4.1. ALICI, internet sitesinde sözleşme konusu ürünün temel nitelikleri, satış fiyatı, ödeme şekli ve teslimata ilişkin ön bilgileri okuyup bilgi sahibi olduğunu ve elektronik ortamda gerekli teyidi verdiğini beyan eder.

4.2. Sözleşme konusu ürün, yasal 30 günlük süreyi aşmamak koşulu ile her bir ürün için ALICI'nın yerleşim yerinin uzaklığına bağlı olarak internet sitesinde belirtilen süre zarfında ALICI'ya veya gösterdiği adresteki kişi/kuruluşa teslim edilir.

4.3. SATICI, sözleşme konusu ürünün sağlam, eksiksiz, siparişte belirtilen niteliklere uygun teslim edilmesinden sorumludur.

MADDE 5 - CAYMA HAKKI VE İSTİSNALARI

5.1. ALICI, ürünü teslim aldığı tarihten itibaren 14 (on dört) gün içinde hiçbir gerekçe göstermeksizin sözleşmeden cayma hakkına sahiptir.

5.2. Kozmetik ve Kişisel Bakım Ürünleri Özel Hükmü: Mevzuat gereği, cilt bakımı ve kozmetik ürünlerinde cayma hakkının kullanılabilmesi için ürünün ambalajının açılmamış, koruma bandının yırtılmamış ve ürünün kesinlikle kullanılmamış/denenmemiş olması şarttır. Bu şartları sağlamayan ürünlerin iadesi yasal olarak kabul edilmemektedir.

MADDE 6 - YETKİLİ MAHKEME VE UYUŞMAZLIKLARIN ÇÖZÜMÜ

İşbu sözleşmenin uygulanmasında, Ticaret Bakanlığı'nca ilan edilen parasal sınırlara kadar, ALICI'nın veya SATICI'nın yerleşim yerindeki Tüketici Hakem Heyetleri veya Tüketici Mahkemeleri yetkilidir. İşbu sözleşme elektronik ortamda taraflarca okunup, kabul edilip teyit edilmiştir.

ARTICLE 1 - PARTIES

1.2 BUYER INFORMATION

The real or legal person who shops through the e-commerce site, as stated in the order form and invoice details.

ARTICLE 2 - SUBJECT

The subject of this Agreement is the determination of the rights and obligations of the parties in accordance with the provisions of the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts, regarding the sale and delivery of the product ordered by the BUYER electronically through the SELLER's website.

ARTICLE 3 - PRODUCT AND PAYMENT

The type, quantity, brand/model, sale price and payment method (Credit Card / PayTR Secure Payment Infrastructure) of the products consist of the information at the time the order is finalized. The BUYER agrees to comply with all banking rules in credit card payments made through the PayTR virtual POS infrastructure.

ARTICLE 4 - GENERAL PROVISIONS

4.1. The BUYER declares that they have read and are informed about the essential characteristics, sale price, payment method and delivery information of the product on the website, and have given the necessary confirmation electronically.

4.2. The product shall be delivered to the BUYER or the person/organization at the address indicated, within the period stated on the website depending on the distance of the BUYER's place of residence, not exceeding the legal 30-day period.

4.3. The SELLER is responsible for delivering the product in good condition, complete and in accordance with the specifications stated in the order.

ARTICLE 5 - RIGHT OF WITHDRAWAL AND EXCEPTIONS

5.1. The BUYER has the right to withdraw from this contract within 14 (fourteen) days from the date of receiving the product, without giving any reason and without penalty.

5.2. Special Provision for Cosmetic and Personal Care Products: In accordance with regulations, in order to exercise the right of withdrawal for skincare and cosmetic products, the product's packaging must be unopened, the protective seal must be intact, and the product must not have been used or tried in any way. Returns of products that do not meet these conditions are not legally accepted.

ARTICLE 6 - COMPETENT COURT AND DISPUTE RESOLUTION

In the implementation of this contract, Consumer Arbitration Committees or Consumer Courts at the place of residence of the BUYER or SELLER are authorized up to the monetary limits announced by the Ministry of Trade. This contract has been read, accepted and confirmed by the parties electronically.
